Turpin Miller’s public law team represents individuals in challenges against decisions and failures to act by public bodies that deprive people of their basic liberties and entitlements.

We assist clients by bringing applications for judicial review in the High Court and Upper Tribunal to challenge these unlawful decisions and omissions. We also represent clients in claims for compensation for any loss and harm suffered due to unlawful decisions—for example, individuals who have been unlawfully detained by the Home Office or left street homeless.

We have extensive experience representing individuals and organisations across the country in challenging unlawful public law decisions, and we are happy to assist from an early stage. We have successfully brought public interest challenges and work closely with senior barristers to progress these claims.

We have particular expertise and experience in bringing public law challenges in the following areas:

  • Release from immigration detention

  • Removal directions set by the Home Office

  • Home Office decisions to deny individuals a right of appeal, or to certify their appeal to be heard only from out of country

  • Homeless and destitute individuals urgently seeking accommodation from the Home Office

  • Individuals housed in unsuitable Home Office accommodation seeking alternative accommodation

  • Negative Home Office decisions rejecting an individual's account of being a victim of trafficking or modern slavery

  • Failures by the Home Office to provide adequate support to victims of trafficking, including the provision of safe house accommodation

  • Decisions to exclude victims of trafficking from support under the public order disqualification policy

  • Home Office electronic tagging decisions

  • Failures by the NHS, social services, and children’s services to accommodate medically vulnerable individuals, care leavers, and parents of young children who are excluded from mainstream homelessness support due to their immigration status

We are able to assist under legal aid for those on a low income, or via cost-effective private arrangements where legal aid is not available.
