Skilled Workers: Keep an eye on your status!

The Court of Appeal has determined[1] that the Home Office does not owe a general duty, regardless of the circumstances, to notify Skilled Workers who are dependent on a sponsor licence that the licence has been revoked.

What this means in practice is that the Home Office may proceed straight to visa cancellation. Generally the Home Office will give 60 days’ notice of the cancellation, unless it considers that the individual has in some way been complicit in the reasons for licence revocation. There are two key messages for Skilled Workers. First, keep an eye open for emails from the Home Office. It is possible that Home Office messages will go straight into Junk so check your Junk folder regularly too. Second, if you do receive notice of visa cancellation, it is important to look urgently for new sponsorship. The list of employers that hold a sponsor licence is updated daily by the Home Office.
