Community Care covers a wide variety of legal issues concerning the safety and welfare of those who are elderly, disabled, have mental health issues, or are otherwise vulnerable.

The issues we assist with include:

  • Ensuring that you or someone you care for receives a proper assessment of their care needs and that those needs are met in a manner which retains a person's dignity.
  • Providing comprehensive and practical advice about care options, financial implications of those options.
  • Advising on charging for care, and ensuring that charges by care homes and councils are lawful.
  • Providing advice to carers as to their rights and assisting them in seeking additional support.
  • Advising children with special needs and their parents about accessing adequate support to meet their needs.
  • Advising Attorneys and Court of Protection Deputies of their legal duties.
  • Preparing lasting powers of attorney and applications for deputyships for financial and welfare decisions.
  • Conducting Court of Protection cases.
  • Advising in relation to applying human rights legislation and equality laws;
  • Representing you in applications to the High Court for Judicial Review.
  • Advising vulnerable migrants and migrants with children on what subsistence and care support may be available to them.

Funding

We have a variety of levels of fee earners who can offer different private rates and some types of work can be completed on a fixed fee basis.

Legal aid is available for some cases, for example where a disabled person is unable to claim benefits because of their immigration status. We will also appeal decisions for Direct Payments to ensure that any money paid by social services for care at home, actually meets the needs of the individual.
